Fundamental principals

Bergviks Auktionsjänst, organization number 559014-4217, Bäckforsvägen 11, 826 67 Bergvik (hereinafter "The Auction House") is subject to the provisions of the EU's new data protection regulation, and is the personal data controller for the data that is collected and processed about you as a customer. The auction house undertakes to respect and protect your personal data and your personal integrity in accordance with current legislation, industry rules and other relevant standards.

The Auction House attaches great importance to the protection of the personal integrity of submitters, bidders, buyers and other persons who visit or otherwise have contact with the Auction House, regardless of whether this takes place on the internet or during a personal visit or otherwise. Personal data and other data collected are treated as a starting point strictly confidentially in accordance with what appears in this policy. What is prescribed in this data protection policy applies in addition to what is prescribed in the Auction House's terms and conditions of purchase and sale. By visiting the Auction House's website or showrooms or if you use the Auction House's services in any other way, you accept what is stipulated in the Auction House's data protection policy and the Auction House's processing of your personal data. The auction house's data protection policy does not apply to other websites, even if there are links to them on the auction house's website. The data protection policies of such operators should therefore be checked before visiting their websites.

What is personal data?

Personal data is information about personal or material circumstances that relate to or can be derived from a certain person, for example information about name, postal address, e-mail address and the like.

Collection and processing of personal data

For those who visit the Auktionshuset's website, the Auktionshuset saves by default the IP address that the visitor has been assigned, the website from which the visit takes place as well as the time and duration of the visit as well as all information in connection with placing a bid. In addition, information is saved about how the customer otherwise interacts electronically with the Auction House and about how the Auction House's website is used. Apart from the individual himself, personal data regarding name, address and other contact information may be obtained from publicly available sources. Regarding the person who registers as a bidder, credit reference information may also be collected in accordance with current legislation. If there are special reasons, other personal data may also be collected from external sources.

In order for Auktionshuset to be able to fulfill its legal obligation in accordance with the Act on the sale of used goods (1999:271), information about your social security number or date of birth, as well as verifying information (such as a copy of an identity document) is collected when you submit an item for sale.

The personal data and bank account details you provide to us in connection with the sale of goods are stored in accordance with the Accounting Act (1999:1078), and so that we can carry out a payment to your bank account after a completed sale.

The auction house cooperates with police authorities in Sweden and the EU, and may, if legally required of us, disclose information to the relevant authorities.

Use and forwarding of personal data

The auction house uses personal data provided by the individual and obtained in other ways to the extent required for technical administration and development of the auction house's website, administration of bidding at auctions, handling of other customer-related matters, statistics and customer analyzes and own investigations in general, statutory disclosure of information and fulfillment of other tasks of public interest. For those who do not expressly prohibit this, provided and otherwise obtained personal data is also used to inform about the Auction House's services.

Cookies

Otherwise, only personal data is disclosed to the extent prescribed by law. Data may also be disclosed after a balance of interests in each individual case to fulfill tasks of general interest. In these cases, information is provided only to the extent that is required in the individual case to satisfy the stated purpose. In addition, the Auction House may disclose personal data in the event that the Auction House engages external service providers who carry out assignments on behalf of the Auction House. A prerequisite is that these have a data protection policy that at least corresponds to this data protection policy in terms of the protection of personal data. The auction house never discloses any personal data to third parties for marketing, unless the individual concerned has expressly approved such disclosure. All employees at and at the Auction House, as well as the contractors whom the Auction House engages for the handling of personal data, have been informed of the confidentiality and have undertaken in writing to comply with it.

How long are personal data saved?

Personal data is saved as long as necessary to fulfill the purposes for which it was collected. If the individual concerned requests that collected personal data be destroyed immediately, unless the Auction House must save the data in order to be able to fulfill entered into agreements, fulfill a statutory obligation to provide information or the data otherwise must be saved according to law or in order for the Auction House to be able to fulfill a task of public interest. In such cases, the data is saved for as long and to the extent required for the agreements to be fulfilled or for prescribed information to be provided or for other reasons the data must be saved according to law (normally this means that the data must be saved for ten years) or must be saved for that tasks of public interest must be able to be fulfilled (in such cases the data can be saved for more than ten years). Information of general interest primarily aims at information regarding cultural historical documentation, cultural historical provenance information and information that may be of importance to the investigation of crime. Where is the personal data stored?

Submitted and otherwise collected personal data is stored in Sweden and/or another country within the EU, EEA or the United Kingdom. Names and e-mail addresses, but no other personal data, may also be stored in the United States to the extent required for sending newsletters and invitations. By agreement, such cases have been stipulated that the same data protection shall be applied as applies according to the EU's data protection regulation.

Right to information and complaints

Anyone who wishes to receive information about or correction of their own personal data that is processed by the Auction House or that provided personal data shall not be used for marketing purposes has the right to request this free of charge in writing from the Auction House at the following address: Lappstadsvägen 13, 826 68 Bergvik. Anyone who has questions about the Auction House's handling of personal data or is dissatisfied with this handling can also contact the Auction House at the address just given. Anyone who is still dissatisfied with the Auktionshuset's processing of personal data can submit a complaint to Datainspektionen (www.datainspektionen.se), which is the Swedish supervisory authority regarding the EU's data protection regulation. Anyone who is dissatisfied can also turn to the supervisory authority in the country where he or she lives or works.
